Henry Daniel St Just in Penwith 1840 Farmer

In the name of God Amen. This is the last will and testament of Henry Daniel of the Parish of Saint Just in Penwith in the County of Cornwall. Farmer.

First - I give devise and bequeath unto my dear wife Mary Ann Daniel all and every my Freehold and Leasehold Messuages, Lands, Tenements, Hereditaments and Premises, and all other my goods, chattels monies, rights, credits, property and effects whatsoever and wheresoever to hold to her during the term of her natural life. But in case my said wife shall marry after the time of my decease their on such day of her marrying all and every the Property and effects of every nature and description herein before given and devised unto her my said wife shall devolve unto my daughter Mary Ann Eddy to hold to her from my said wife's marriage day during the term of her natural life, but in case my said wife shall not marry after my decease then at and after the time of the decease of my said wife I give devise and bequeath unto my said daughter all and every my Freehold and Leasehold property and effects of every kind to hold the same unto my said daughter during the term of he natural life. An at and after the decease of my said daughter I give, devise, and bequeath unto my grandson Henry Daniel Eddy all that my Freehold Estate situate in the tenement of Bostrase in the said parish of Saint Just to hold to him his heirs and assigns forever, he paying thereout unto his Father James Eddy the sum of three pounds yearly during the time his said Father shall live without marrying and no longer.

Also, at and after the time of the decease of my said daughter I give, devise, and bequeath unto my grandson James Eddy all those my two messuages or dwelling houses situate in the tenement of Laprowda in the said Parish of St Just to hold to him his Executors Aministrators and Assigns during my estate, term and interest therein, he duly paying thereout unto his Father the said James Eddy the sum of three pounds yearly so long as his father shall remain a widower and no longer.

Also, at and after the time of the decease of my said daughter I give devise and bequeath unto my grandaughter Mary Jane Eddy all that the largest of my three messuages or dwelling houses situate in the tenement of Bojewyan in the said Parish of Saint Just to hold to her and her Executors, Administrators and Assigns during my estate, term and interest therein, she paying thereout unto her Father the said James Eddy the sum of one pound and ten shillings yearly so long as he shall remain a widower and in case my said daughter shall have no more children then my grandaughter Mary Jane shall have one of my other dwelling houses in Bojewyan aforesaid she paying thereout unto her Father the said James Eddy the sum of one pound and ten shillings while he shall continue a widower, and her Father the said James Eddy shall have the other dwelling house during his widowhood .

And in case my said daughter shall have another child, that child shall have the latter dwelling house herein before given to Mary Jane Eddy, such child paying therout unto the said James Eddy the sum of one pound and ten shillings while he shall continue a widower.

Also I give and bequeath unto John Uren the sum of Five Pounds the same to be paid to him by my said daughter at the end of eighteen months after the decease of my said wife. And all the rest residue and remainder of my property I give, devise, and bequeath among my grand children in equal portions as tenants in common, and I hereby direct that neither my daughter nor any of her children shall have power to sell transfer or mortgage any part of my property herein before given to them or either of them.

And I do also hereby make nominate and appoint my said wife Mary Ann Daniel the whole and sole Executrix of this my last will and testament utterly revoking and disannulling all former wills made by me. In witness whereof I have hereunto set my hand and seal this fourteenth day of August in the year of our Lord one thousand eight hundred and forty.
